Equifax Dispute – You’re probably reading this article right now because you may have also found yourself in a dreaded & lengthy episode of resolving an Equifax dispute. If you’re like me, this process has got you nowhere, and your frustration is mounting. If you get where I’m coming from, let me share my experience of finally beating an Equifax dispute at a pre-trial conference.
I Sued Over An Equifax Dispute!!
What happened was, a series of tax liens had unlawfully appeared on my credit reports. I knew my basic rights, so I took some time and effort to send dispute letters to each credit bureau – informing them to delete the incorrect information under The Fair Credit Reporting Act.
It was clear to Transunion & Experian that the false tax lien entry was unverifiable. So, they were quick to follow Fair Credit Reporting Acts guidelines, and delete the misinformation. Equifax, however, was not as compliant and refused to delete the misinformation from my credit report – I was NOT okay with this decision, as it left had left my Equifax dispute unresolved! So, I sued Equifax.
By Law, The Equifax Dispute Must Be Deleted!
After I began the initial lawsuit process, I went to a pre-trial conference to go head-to-head with Equifax’s legal team – to determine if a settlement could be reached outside of court. The meeting took place before mediators, and I was represented by Lexington Law.
My representative from Lexington Law stated the law as follows: “The Fair Credit Reporting Act indicates that the consumer has the right to request that the credit bureaus verify the accuracy of reported information. If they can not verify their information with the furnisher (the organization that furnishes the credit bureau with account information), and cannot verify the accuracy of ALL of the information (that is, 100% of the information MUST be verifiable, not just part of it) – then the inaccurate information on the credit report must be deleted”.
Thanks To My Legal Rep, My Equifax Dispute Was Removed!
The Equifax representative stated that the information on my credit report had been verified by the County Recorder’s office, and that since the tax liens showed up on my records, the ‘unresolved’ status of my Equifax dispute was justified. However, my Lexington Law representative counter-argued that, according the Fair Credit Reporting Act, the verification must be provided by the original furnisher (the IRS) – not the County Recorder’s office. Since Equifax’s failed to prove verification, the court found the information to be insufficient. Also, since Equifax didn’t complete their investigation within the required 30 day period, the court ruled the the tax lien entry as unlawful.
As a result, the court ordered the immediate removal of the Equifax Dispute!
My attempts to solve this Equifax dispute on my own had been disasterous. I learned through countless forums that I wasn’t the only one going through this type of situation. - If ANY information on your credit report cannot be verified 100%, it MUST be deleted by law.
- During the pre-trial period, the credit bureaus investigation must be completed within 30 days (with 100% accuracy), or the Equifax dispute MUST be deleted by law.
